Abstract
針對國家為防治傳染病所擁有之公衛權力與界限，本計畫將就現行傳染病防治法及相關法規中的介入手段進行體系性檢討。除了分析核心的防治不同手段應具備的合法性基礎及必要內容，亦依照最新公共衛生倫理、法律理論及國際立法指引原則，就重建防治措施體系提出修法條文建議，為具有壓迫性的防治手段提供明確要件與程序，促進傳染病防治法律之現代化，並成為進一步建置緊急公衛事件下法律治理框架之基礎。
